Personal data (hereinafter also referred to simply as “data”) is processed by us only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.

Pursuant to Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter “GDPR”), “processing” means any operation or set of operations which is performed on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

With the following privacy policy, we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide alone or jointly with others on the purposes and means of processing. Furthermore, we inform you below about the third-party components we use for optimisation purposes and to improve the quality of use, insofar as third parties process data in turn under their own responsibility.

II. Rights of users and data subjects

With regard to the data processing described in more detail below, users and data subjects have the right

  • to obtain confirmation as to whether personal data concerning them is being processed, access to the data being processed, further information about the data processing and copies of the data (cf. also Art. 15 GDPR);
  • to request the rectification or completion of inaccurate or incomplete data (cf. also Art. 16 GDPR);
  • to obtain the erasure of personal data concerning them without undue delay (cf. also Art. 17 GDPR), or, alternatively, where further processing is necessary in accordance with Art. 17(3) GDPR, to obtain restriction of processing in accordance with Art. 18 GDPR;
  • to receive the data concerning them and which they have provided and to transmit those data to other controllers (cf. also Art. 20 GDPR);
  • to lodge a complaint with a supervisory authority if they consider that the processing of personal data concerning them by the provider infringes data protection provisions (cf. also Art. 77 GDPR).

In addition, the provider is obliged to inform all recipients to whom data have been disclosed by the provider of any rectification or erasure of personal data or restriction of processing carried out pursuant to Articles 16, 17(1) and 18 GDPR. This obligation does not apply, however, where such notification proves impossible or would involve a disproportionate effort. Irrespective of this, the user has a right to obtain information about these recipients.

Users and data subjects also have the right to object to the future processing of personal data concerning them pursuant to Art. 21 GDPR, where the data are processed by the provider on the basis of Art. 6(1)(f) GDPR. In particular, an objection to processing for the purposes of direct marketing is admissible.

III. Information on data processing

The data processed when you use our website will be erased or blocked as soon as the purpose of storage ceases to apply, provided that no statutory retention obligations conflict with erasure and no different information is provided for individual processing procedures below.

Server data

For the purpose of providing and displaying the website, certain connection data are processed. For technical reasons, in particular to ensure a secure and stable website, data are transmitted from your internet browser to us or to our web space provider. Using these so-called server log files, among other things, the type and version of your internet browser, the operating system, the websites of our internet presence that you visit, the date and time of each access, as well as the IP address of the internet connection from which our website is accessed are collected.

These data collected in this way are stored temporarily, but not together with other data about you.

This storage takes place on the legal basis of Art. 6(1)(f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our website.

The data are erased at the latest after 14 days, provided that no further retention is required for evidentiary purposes. Otherwise, the data are wholly or partially exempt from erasure until a final clarification of an incident has been achieved.

If you contact us via email or the contact form, the data you provide will be used to process your request. The provision of the data is necessary for processing and answering your request – without the provision of the data we cannot process your request, or can only do so to a limited extent.

The legal basis for this processing is Art. 6(1)(b) GDPR.

Your data will be erased if your request has been conclusively answered and no statutory retention obligations stand in the way of erasure, such as, for example, in the context of a subsequently initiated contractual relationship.

Online applications / publication of job advertisements

We offer you the opportunity to apply to us via our website. In the case of digital applications, your applicant and application data are collected and processed electronically by us for the purpose of handling the application process.

The legal basis for this processing is Section 26(1) sentence 1 BDSG (German Federal Data Protection Act) in conjunction with Art. 88(1) GDPR.

If, following the application process, an employment contract is concluded, we will store the data you provided at the time of application in your personnel file for the purpose of the usual organisational and administrative process – naturally with due regard for further legal obligations.

The legal basis for this processing is likewise Section 26(1) sentence 1 BDSG in conjunction with Art. 88(1) GDPR.

If an application is rejected, we automatically erase the data transmitted to us two months after notification of the rejection. Erasure will not take place, however, if the data must be stored for a longer period due to legal provisions, e.g. due to obligations to provide evidence under the German General Equal Treatment Act (AGG), for up to four months or until the conclusion of court proceedings.

In this case, the legal basis is Art. 6(1)(f) GDPR and Section 24(1) no. 2 BDSG. Our legitimate interest lies in legal defence or enforcement.

If you expressly consent to a longer storage of your data, for example for inclusion in a pool of applicants or interested parties, the data will be further processed on the basis of your consent. The legal basis is then Art. 6(1)(a) GDPR. You may withdraw your consent at any time with effect for the future pursuant to Art. 7(3) GDPR by notifying us accordingly.

In order to promote our products and services and to communicate with interested parties or customers, we maintain a company presence on the Facebook platform.

The legal basis for the processing of personal data described below and carried out by Facebook is Art. 6(1)(f) GDPR. Our legitimate interest lies in the analysis, communication as well as the sale and promotion of our products and services.

The legal basis can also be the user’s consent pursuant to Art. 6(1)(a) GDPR given to the platform operator. The user may withdraw this consent at any time for the future in accordance with Art. 7(3) GDPR by notifying the platform operator.

When our online presence on the Facebook platform is accessed, user data (e.g. personal information, IP address etc.) are processed by Facebook Ireland Ltd. as operator of the platform in the EU.

These user data are used to provide statistical information on the use of our company presence on Facebook. Facebook Ireland Ltd. uses these data for market research and advertising purposes as well as to create user profiles. Based on these profiles, Facebook Ireland Ltd. is, for example, able to advertise users inside and outside Facebook in a way that is based on their interests. If the user is logged into their Facebook account at the time of access, Facebook Ireland Ltd. can additionally link the data with the respective user account.

If a user contacts us via Facebook, the personal data entered by the user on this occasion are used to process the inquiry. The user’s data will be erased by us provided the user’s query has been conclusively answered and provided that no legal retention obligations, such as in the case of a subsequent contract processing, stand in the way.

In order to process the data, Facebook Ireland Ltd. may also set cookies.

If the user does not agree with this processing, it is possible to prevent the installation of cookies by making the appropriate settings in the browser. Cookies that have already been stored can also be deleted at any time. The settings depend on the browser used. In the case of Flash cookies, processing cannot be blocked through the browser settings but by adjusting the settings of the Flash player. If the user prevents or restricts the installation of cookies, this may lead to not all functions of Facebook being fully usable.

Links to social media via graphics and text

We also promote our presence on the social networks listed below on our website. Integration is carried out via linked graphics to the respective networks. By using these linked graphics, it is prevented that a connection to the server of the respective social network is automatically established when a website with a social-media promotion is accessed, in order to display a graphic of the network itself. Only by clicking on the respective graphic is the user forwarded to the service of the respective social network.

After forwarding, the respective network collects information about the user. It cannot be ruled out that the data thus collected are processed in the USA.

These data include, in the first instance, data such as IP address, date, time and visited page. If the user is logged into their user account of the respective network at that time, the network operator may be able to assign the information collected about the specific visit to the user’s personal account. If the user interacts via a “Share” button of the respective network, this information can be stored in the user’s personal account and possibly published. If the user wishes to prevent the collected information from being assigned directly to their user account, they must log out before clicking on the graphic. In addition, it is possible to configure the respective user account accordingly.
